Terms of Service - Family Circle

These Terms of Service ("Terms") govern your use of the Family Circle mobile application and related services ("Family Circle" or the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Family Circle provides household organisation features which may include shared calendars, notes, recipes, meal plans, shopping lists, reminders and other family-planning tools.
The Service is currently provided free of charge. Features may be added, changed or removed over time.
Family Circle may accept voluntary donations to help support development, hosting and other operating costs. Unless expressly stated otherwise, making a donation does not purchase additional Service rights, guarantee continued operation, or create entitlement to particular features.
2. Eligibility and accounts
- You must be at least 13 years old to create or operate a Family Circle account.
- If you are under 18, you should use the Service with the knowledge and appropriate involvement of a parent or guardian.
- Sign-in is currently provided using a Google account. Your use of your Google account remains subject to Google's applicable terms and security controls.
- You are responsible for activity carried out through your account and for taking reasonable steps to keep your Google account secure.
- You must not obtain or use another person's account without permission.
3. Family circles and user content
- You control who you invite to a family circle using the invitation features provided by the Service.
- Information entered into shared features may be visible to other members of your circle.
- You retain any intellectual-property rights you have in content you submit.
- You grant Orion Automator a limited, non-exclusive licence to host, store, process, reproduce and display your content only as reasonably necessary to provide, maintain, secure and operate Family Circle.
- You must not upload or share content that is unlawful, abusive, malicious, defamatory, infringing or otherwise violates the rights of another person.
- Circle administrators may remove members where the Service provides that functionality.
- Leaving or being removed from a circle may affect your ability to access content associated with that circle.
4. Google and third-party services
Family Circle uses third-party services to provide parts of the Service.
Google Sign-In and optional Google Calendar functionality are provided using Google services and may require permissions through Google OAuth. Your use of Google services is also subject to Google's applicable terms and policies.
Family Circle currently uses Supabase to provide cloud infrastructure including database, authentication-related infrastructure and file storage.
Third-party services may experience outages, change their services or discontinue functionality outside Orion Automator's control.
5. Acceptable use
You must not:
- Attempt to gain unauthorised access to another account, circle, database or system
- Use the Service to distribute malware, spam or unlawful material
- Deliberately interfere with, overload or disrupt the Service or its infrastructure
- Scrape or automatically extract data from the Service without permission where doing so would interfere with the Service, violate applicable law or compromise other users' information
- Circumvent authentication, authorisation, security or access controls
- Impersonate another person or materially misrepresent your identity
- Use the Service in a way that infringes another person's intellectual-property, privacy or other legal rights
Nothing in these Terms prevents activity that cannot lawfully be restricted, including any rights you may have under applicable law relating to interoperability, security research or software analysis.
6. Privacy
Our Privacy Policy explains how Family Circle collects, uses, stores, shares and protects personal information and explains your data-protection rights.
Please read the Privacy Policy before using the Service.
7. Availability, reminders and information
Family Circle is provided on an "as available" basis. We aim to keep the Service working reliably, but we do not guarantee that it will always be available, uninterrupted or error-free.
You should not rely on Family Circle as the sole method of storing information that would cause serious harm if lost or unavailable. Where information is important, you should maintain an appropriate independent copy or backup where reasonably possible.
Notifications and reminders may be affected by device settings, battery optimisation, operating-system behaviour, network availability and third-party services. You should not rely on Family Circle reminders for emergencies, medical treatment, safety-critical activities or other situations where a missed notification could cause serious harm.
Shopping-price information and estimates are based on information entered by users unless expressly stated otherwise. They should not be treated as guaranteed or live retailer prices.
8. Liability and statutory rights
Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Nothing in these Terms affects any mandatory rights or remedies you have under applicable consumer law.
To the extent permitted by law, Orion Automator is not responsible for losses that were not reasonably foreseeable when you began using the Service, or for losses caused by circumstances outside our reasonable control.
Family Circle is currently provided free of charge. To the extent permitted by applicable law, Orion Automator will not be responsible for purely commercial or business losses arising from personal or household use of the Service, including loss of profits, business opportunities or anticipated savings.
9. Suspension and termination
You may stop using Family Circle at any time.
You may request deletion of your account using our account deletion process.
We may restrict, suspend or terminate access where reasonably necessary, including where:
- you materially or repeatedly breach these Terms;
- your use creates a security, legal or technical risk;
- we reasonably believe the account is being used unlawfully or maliciously; or
- Family Circle or a necessary part of the Service is discontinued.
Where reasonable and lawful, we will try to provide appropriate notice before permanently discontinuing the Service or terminating an account for reasons unrelated to misconduct or security.
10. Changes to the Service
Family Circle is an independently developed free service and may continue to evolve. We may update, add, remove or modify features for technical, security, legal, operational or development reasons.
Where a change materially affects existing users, we may provide notice in the app or by another appropriate method where reasonably practical.
11. Changes to these Terms
We may update these Terms when Family Circle changes or where updates are needed for legal, security or operational reasons.
The "Last updated" date will be changed when these Terms are updated.
Where a material change significantly affects your rights or obligations, we may provide additional notice before or when the change takes effect.
12. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or in another jurisdiction, this clause does not deprive you of mandatory consumer protections or rights that apply to you under the law of your place of residence.
Nothing in these Terms is intended to prevent a consumer from bringing proceedings in a court where they are entitled to do so under applicable law.
13. Intellectual property
Except for user-created content and third-party materials, the Family Circle application, branding and original content are owned by or licensed to Orion Automator and are protected by applicable intellectual-property laws.
No affiliation with any other family organisation application or service is implied unless expressly stated.
